Any works displayed across social media and this website are under copyright.

By commissioning any services from me, Harlen Chen, the creator, you, the client, automatically agree to the terms and conditions listed below. These terms and conditions are similar in the contracts, as these rights protect both the creator and client.

  • As contracts are provided, client information (Name, Phone, Email & Address) must be provided to ensure the contract is legally binding.

  • Client’s information and confidentiality is protected in perpetuity.

  • Number of included revisions (3). Revisions which exceed the number or which are not the fault of the artist will be billed separately.

  • Cancellation fees: 10% before the preliminary sketches, 50% after final draft, 100% upon completion.

  • Payment is due within 30 days. 1.5% per month is due on overdue accounts.

  • Payment only through Paypal or (if within Canada) Interac.

  • Grant of any rights is conditional upon payment in full.

  • All rights not expressly granted remain property of the artist.

  • All sketches and preliminary work remain property of the artist.

  • Client may not edit, correct, adapt, modify or change the finished artwork in any way without written permission from the artist. This depends on the circumstances, (i.e., gifts, postcards from Etsy, etc.).

  • Client will indemnify and hold artist harmless against any claim arising from artist’s reliance upon reference material provided to the artist by the client (regarding physical references sent).

  • Artist reserves the right to use art for self-promotion. (i.e. website, portfolio, promotional directories) unless stated otherwise.

  • If commission is used on social media, source the materials provided anywhere visible on profile (i.e. Art by Oakhorn/Harlen Chen).

  • I, Harlen Chen, do not agree to the terms for any of my works to be used for AI, or any related AI devices; training or otherwise. It is a breach of contract, and copyright infringement. This includes NFTs. Even if the contract has been agreed on that a product is to be licensed to sell, AI/NFT usage and distribution is forbidden.
